Affiliate Agreement
Effective Date: November 24, 2025
This Affiliate Agreement (“Agreement”) is made between Unemployable, LLC (the “Company”) and you (the “Affiliate”).
By creating an account, activating access, or promoting the People Getting Paid system (the “Program”), you agree to the terms below.
1. Independent Contractor Status
You are an independent contractor and not an employee, partner, joint-venturer, or legal representative of the Company.
You are solely responsible for:
- Running your own business operations and marketing activities.
- Paying and reporting all applicable taxes on income you earn.
- Complying with all laws, rules, and regulations in your jurisdiction.
The Company does not provide employee benefits, does not withhold taxes, and is not responsible for your debts, obligations, or liabilities.
2. Program Overview & Access
When you pay a US $5 activation, you receive a 24-hour pass to the People Getting Paid back office. During that 24-hour access window you may receive:
- Back office access with live stats, referrals, and payouts for that period.
- A unique invite link that credits activations to you.
- Access to the Invitation Engine to send done-for-you (DFY), trackable email invitations.
- Entries into the Community Cash-Line (rotator) as described on the site.
- The ability to feature up to two of your own offers or income streams to your personal referrals.
- Access to community resources (e.g., Discord, live activity feed) as provided by the Company.
Access is one day (24 hours) at a time. This is not a subscription. You choose when to pay $5 and when not to.
3. Commission Structure – $5 Activations
Commissions on the core US $5 activation are primarily paid peer-to-peer and follow the structure below:
- For each qualifying referral who activates for $5 using your tracking link, a $5 commission is created.
- For your first 10 personal referrals:
- You keep commissions from referrals #1, #3, #5, #7, and #9.
- Commissions from referrals #2 and #4 are passed up to your inviter (upline).
- Commissions from referrals #6, #8, and #10 are allocated to the Community Cash-Line (rotator).
- Beginning with referral #11 and beyond, you keep 100% of all $5 commissions you personally generate (subject to eligibility and fees described in this Agreement).
The Company may adjust or withhold commissions in cases of fraud, fake activations, chargebacks, policy violations, or misuse of the system.
4. Optional Boosts & Upgrade Commissions
Affiliates may optionally purchase Boosts, which increase visibility in the Community Cash-Line and unlock additional upgrade commissions:
- $20 Boost: Adds +20 positions in the Community Cash-Line and, when active, qualifies you to earn $10 on each $20 Boost purchased through your link.
- $100 Boost: Adds +100 positions in the Community Cash-Line and, when active, qualifies you to earn $50 on each $100 Boost and $10 on each $20 Boost purchased through your link, subject to the Program’s current rules.
To receive any Boost commissions, you must be at the appropriate Boost level (e.g., have an active $20 or $100 Boost) at the time the upgrade sale is processed. If you are not at the required Boost level, the applicable Boost commission may roll up to the next eligible upline member who is properly boosted.
5. Founders Pass & 50% Upgrade Commissions
The Program offers an optional Founders Pass upgrade (available in quarterly, annual, and lifetime options or as otherwise published in the back office). The Founders Pass is not required to participate in the core $5 activations, but it provides additional leverage and commission potential:
-
Founders Pass benefits include (but are not limited to):
- Increased long-term visibility and additional Community Cash-Line entries for the duration of your Founders Pass (e.g., three months, one year, or lifetime, depending on level).
- Eligibility to earn 50% commissions on qualifying Founders Pass purchases made through your tracked referrals.
- Additional “founder-level” perks and positioning as described in the back office and/or sales pages, which may evolve over time.
-
50% Founders Pass commission eligibility:
To earn Founders Pass commissions, you must:
- Hold an active Founders Pass at the time the referral upgrades (at the same or higher level, as specified in the back office).
- Be in good standing with no current suspension or restriction on your account.
- Have the Founders Pass purchase properly tracked to your affiliate link or system-assigned tracking ID.
-
Commission amount:
When you are eligible, you earn a commission equal to 50% of the Founders Pass purchase price actually paid by your qualifying referral (less any applicable processing fees or adjustments disclosed in the back office).
-
Pass-up of Founders Pass commissions if you are not a Founder:
If, at the time your referral purchases a Founders Pass, you do not hold an active Founders Pass:
- You agree that all 50% Founders Pass commissions on that transaction will be permanently passed up to the next qualified upline Founders Pass holder (or, if none exists, to the Company).
- You understand and agree that you are not entitled to any portion of that specific Founders Pass commission.
-
No refunds on Founders Pass:
Founders Pass purchases are digital, unlock immediate positioning and long-term benefits, and are therefore non-refundable, except where required by law. Pricing and included benefits may change for new purchasers, but such changes will not typically apply retroactively.
-
Licensing fees still apply:
All members, including Founders, remain responsible for any applicable $1 licensing/infrastructure fees on manual $5 activations as described in this Agreement.
6. The Community Cash-Line (Rotator)
The Program includes a community-based rotator, referred to as the Community Cash-Line. Key points:
- Community Cash-Line positions are entries that can receive shared traffic and potential $5 activations beyond your personal marketing.
- Positions are chosen using a positions-based random selection method. The more positions you hold, the higher your mathematical odds of receiving visitors and potential $5 hits.
- Each $5 activation creates multiple entries for a limited duration, and Founders Passes can grant additional extended-duration entries (e.g., three months, one year, or lifetime, depending on the level you hold).
- Boost purchases and certain actions can add additional positions, as described on the Program’s sales and info pages.
- Activity may spike during high-traffic “surge days,” during which multiple $5 hits may occur for members with strong positioning.
- Earnings examples, rotator scenarios, and projections are illustrative only and not guarantees of results.
The Community Cash-Line is further governed by the separate Rotator Terms published by the Company, which are incorporated into this Agreement by reference.
7. Licensing / Infrastructure Fee
To keep the system sustainable and reduce fake or unverified activations, the Program uses a licensing/infrastructure fee system:
- When you manually activate someone for $5 (i.e., they pay you directly and you confirm them in the system), a US $1 licensing fee posts to your licensing balance.
- Your licensing balance can be cleared at any time by card payment in the back office. A receipt is provided.
- Licensing funds help maintain technology, compliance, and community-wide traffic through the Rotator.
- All members, including Founders and upgraded members, are subject to these licensing fees on manual $5 activations.
The Company may update how licensing fees are structured or settled in the future. Any changes will be posted in the back office or Terms and will apply prospectively.
8. Payouts & Payment Methods
The Program is primarily a peer-to-peer payout system:
- You are responsible for connecting a payout method (e.g., payment app, wallet, Stripe, etc.) to receive funds directly from your customers or from the system as offered.
- When using manual activations, you are responsible for confirming payments properly so that commissions and rotator entries are recorded accurately.
- You may optionally connect Stripe (or other approved processors) to automate payments and activations where supported. Stripe is recommended for automation but is not required.
- In any scenario where the Company manages or centralizes payouts, we may require identity verification, compliance checks, or earnings thresholds for disbursements.
You understand that processing times, fees, and limitations may be controlled by your chosen payment provider and are outside the Company’s control.
9. Eligibility to Earn Commissions
To be eligible to earn and keep any commissions in the Program:
- You must be an active member, meaning you have paid for a $5 activation within the past 24 hours (or such other period specified in the back office at the time).
- You must comply with all Program rules, Rotator Terms, and this Agreement.
- You must have valid and up-to-date contact information in your account.
- You must be in good standing with no current suspension or restriction on your account.
The Company reserves the right to deny or reverse commissions if the above conditions are not met at the time of activation or payout.
10. Tracking Links & Prohibited Practices
To ensure accurate crediting of activations and commissions:
- You must use your own unique tracking link or any system-assigned link (including MailBot or other tools) for referrals.
- You may not clone, spoof, or manipulate tracking links or cookies.
- You may not misrepresent yourself as another member, the Company, or a representative of the Company.
- You may not engage in any activity intended to “game” the rotator, inflate stats, or artificially create entries or activations.
Any suspected abuse may result in immediate suspension, loss of positions, and forfeiture of unpaid commissions.
11. Ethical Conduct & Marketing Compliance
As an Affiliate, you agree to conduct yourself ethically and lawfully, including but not limited to:
- No spamming (email, SMS, social media, or any other channel) in violation of applicable laws (e.g., CAN-SPAM, CASL, GDPR, TCPA).
- No false, deceptive, or misleading claims about earnings, results, or the nature of the Program.
- No use of unauthorized logos, brand assets, or Company creatives without permission.
- When sharing any income examples or screenshots, you agree to include an appropriate income disclaimer making clear that results vary and are not guaranteed.
- No harassment, hate speech, or abusive behavior towards other members, prospects, or Company personnel.
Violations of this section may result in immediate account suspension, removal from the Rotator, and forfeiture of unpaid commissions.
12. No Income Guarantees & Illustrative Examples
Any income figures, daily earning examples (e.g., “$100+/day” scenarios), or community success stories shown on the website or in marketing materials are illustrative only.
- Your actual results depend on your actions, skills, traffic quality, market conditions, and numerous other factors.
- The Company does not guarantee that you will earn any specific amount of money or any money at all.
- Past performance by you or others does not guarantee future results.
13. Refund Policy
Because activations provide instant digital access and payouts are largely peer-to-peer:
- All $5 activations, Boosts, Founders Passes, and related digital access fees are final and non-refundable.
- There are absolutely no refunds on activations or upgrade purchases, except where required by law.
14. Taxes & Reporting (U.S. Residents)
You are responsible for tracking your earnings and paying all applicable taxes in your jurisdiction. If you are located in the United States:
- If you earn more than US $600 in commissions from the Company in a calendar year through any Company-managed payouts, the Company may request your tax information and issue a Form 1099-MISC as required.
- You may also be subject to reporting requirements via third-party processors (e.g., Stripe, PayPal), which are separate from the Company.
15. Termination & Account Suspension
The Company may, in its sole discretion, suspend or terminate your affiliate access at any time, including but not limited to:
- Violation of this Agreement, the Rotator Terms, or any other published policy.
- Fraud, fake activations, chargebacks, or attempts to manipulate payouts.
- Unethical or unlawful marketing practices.
- Harassment or abuse of other members or Company staff.
Upon termination, you may lose access to your affiliate dashboard, rotator positions, and any unpaid commissions at the Company’s discretion. Decisions regarding termination and forfeiture are final.
16. Modifications to the Program & Agreement
The Company may update the Program, commission structure, licensing fees, or this Agreement at any time:
- Changes will generally be posted in the back office and/or on the Program’s official website.
- Continued participation in the Program after any changes are posted constitutes your acceptance of the updated terms.
- If you do not agree with any updated terms, your sole remedy is to discontinue participation.
17. Limitation of Liability
To the maximum extent permitted by law:
- The Company is not liable for any indirect, incidental, special, or consequential damages arising from your participation in the Program.
- The Company’s total liability to you for any claim related to the Program will not exceed the total amount of commissions actually paid to you by the Company in the preceding three (3) months.
18. Governing Law
This Agreement is governed by the laws of the State of Utah, without regard to its conflict of laws principles. Any disputes shall be resolved in state or federal courts located within Utah, to which you consent to personal jurisdiction.
